On September 18, 2024, EPA Region 1 issued an administrative Compliance Order under Section 113(a)(3) of the Clean Air Act to the Town of Fair Haven, VT. The Town of Fair Haven failed to provide EPA with notification at least ten days before demolition work began at two town-owned properties at 5 and 7 Union Street, Fair Haven, VT. The order requires the Town of Fair Haven to comply with the Clean Air Act Asbestos NESHAP. The action addresses demolition work at 5 and 7 Union Street that occurred between February 2022 and March 2024, for which no specific environmental justice issues were identified. The Vermont Department of Health is aware and supportive of this action.
