The Regional Judicial Officer issued a Final Order on September 26, 2024, ratifying the Consent Agreement to commence and settle a penalty action to resolve violations of Sections 312 of EPCRA against ChemStation Philadelphia, Ltd. ( ChemStation ). ChemStation owns and operates a chemical blending facility located in Downingtown, PA. The Consent Agreement alleges that Respondent violated Sections 312 of EPCRA when it failed to submit to the SERC, LEPC, and Local Fire Department a Chemical Inventory Form for calendar years 2022, 2021, and 2020 by March 1 of the following calendar years, putting first responders at risk in case of emergency response. The Settlement provides that ChemStation will pay a penalty of $35,000.00. The facility is not located in an area of EJ concern. EPCRA Section 312 enforcement cannot be delegated to the state; EPA has notified the Commonwealth of this matter.
