Summary

On September 26, 2024, the Director of ECAD, Region 3, entered into an AOC with MAX Environmental Technologies, Inc. ( Respondent ) for violations of its Pennsylvania National Pollutant Discharge Elimination System ( NPDES ) Permit No. PA0027715 ( the Permit ). Respondent is the owner and/or operator of an industrial wastewater treatment plant (WWTP) located at 233 Max Lane, Yukon, PA (the Facility ). The Facility treats and discharges industrial stormwater runoff, leachate, groundwater, and on-lot sewage treatment effluent through Outfall 001 at the Facility. Outfall 001 discharges into Sewickley Creek. Sewickley Creek is a relatively permanent water that connects to the Youghiogheny River. Youghiogheny River is a relatively permanent water that connects to the Monongahela River, a Traditional Navigable Water. Violations identified at the Facility include twenty Permit exceedances of the daily maximum and monthly average limits for biological oxygen demand (BOD), nitrogen, cadmium and zinc. Additionally, Respondent failed to properly operate and maintain the Facility, failed to report sample results in its DMRs, and failed to provide adequate training to its Facility staff. Respondent has agreed to, among other things, retain a Professional Engineer to evaluate the processes and infrastructure of the WWTP, including the causes of the Permit effluent exceedances at the Facility, and to retain an environmental consultant to perform related compliance sampling at
