Summary

On September 30, 2024, the EPA Region 3 entered into a Consent Agreement and Final Order with Main Line Gold Painting, Inc. d/b/a Certa Pro of the Main Line, Inc. ( Certa Pro ) resolving allegations that it had violated the Renovation, Repair and Painting Lead Based Paint rules (RRP) under 40 C.F.R. Part 745, Subpart E, in connection with the renovation of a residential property located in Havertown, Pennsylvania. After receiving a tip/complaint from a neighboring property owner, the EPA conducted a site inspection on September 21, 2022 and a records inspection on December 6, 2022. Based on the information received from the tip/complaint and the information gathered during the inspections, the EPA determined that at the time of the renovation, the renovator failed take extra precautions in containing the work area to ensure that dust and debris from the renovation does not contaminate other buildings or other areas of the property in violation of 40 C.F.R. 745.85(a)(2)(ii)(D). This TSCA requirement protects public health and the environment by protecting occupants of potential lead risks in residential properties. The property at issue was not in an Environmental Justice Community of Concern. The Commonwealth of Pennsylvania was notified of this action. Under the consent agreement, Certa Pro will pay a civil penalty in the amount of Three Thousand Five Hundred and Four Dollars ($3,504) to settle the alleged violation.
