On September 30, 2024, EPA Region 3 entered into an AOC with Denton Scrap Metal Recycling, LLC ( Respondent ) for violations of its Maryland General National Pollutant Discharge Elimination System ( NPDES ) Permit No. MDR003194 ( the Permit'). Respondent is the owner and/or operator of a scrap metal yard located at 24769 A Meeting House Road, Denton, Maryland (the Facility ). Violations identified at the Facility include Failure to Make Necessary Modifications or Determinations in Response to Benchmark Exceedances, Failure to Properly Document Responses to Benchmark Exceedances, Failure to Incorporate a Complete Location Map into the Stormwater Pollution Prevention Plan (?SWPPP?), and Failure to Ensure Good Housekeeping. Respondent has agreed to, among other things, submit Corrective Action Reports to EPA within 30 days of discovery of benchmark exceedances from the average of four consecutive quarters. Respondent shall also submit a revised site map, install further controls in areas of significant staining as identified in the 2022 EPA inspection and in the Order, and develop a written standard operating procedure ( SOP ) addressing the roles and responsibilities of Facility employees. The goal of the Order is for the Respondent to ultimately achieve compliance with its benchmarks and other permit requirements. The Facility is not located in an environmental justice community per EJ screen. EPA has coordinated with MDE throughout the enforcement process.
