This enforcement action addresses violations documented during a November 8-9, 2022 EPA compliance inspection. Violations identified included: Operating a treatment, storage or disposal facility without a RCRA permit or RCRA Interim Status as a result of Respondent?s failure to comply with several conditions applicable to large quantity generators including a) closing satellite accumulation containers, b) properly labeling satellite accumulation containers, c) closing hazardous waste containers, d) implementing Subpart BB requirements for the control of air emissions from equipment leaks, e) performing Subpart CC annual tank inspections, f) minimizing the possibility of fire, explosion, or any unplanned sudden or nonsudden release of hazardous waste, and g) performing daily hazardous waste tank inspections. Respondent has corrected the violations and agreed to pay a penalty in the amount of $205,791.00.
