On September 23, 2024, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) under its authority pursuant to to Section 113(d) of the Clean Air Act, 42 U.S.C. ? 7413(d), to BASF Corporation located in Beaumont, Texas. The CAFO was issued in response to violations of 30 Tex. Admin. Code ? 116.115(c) by emitting emissions directly to the atmosphere from Wastewater Tank WB-501 when Special Condition 10 in the NSR Permit No. 20057 requires that emissions from the wastewater tanks be routed to the Wastewater Tank Scrubber.
The CAFO requires BASF Corporation to pay a penalty and provide an injunctive relief package that includes quarterly OGI and EPA Method 21 inspections of the facility. BASF Corporation must respond to EPA Region 6 within 30 days of each quarterly inspection.
