On November 5, 2024, Region 3 entered a Consent Agreement and Final Order with CleanEdge, LLP that both initiated and resolved an alleged FIFRA violation related to its manufacture and sale of a pesticide. The violation involved misbranding of the pesticide by failing to include the entire approved label on the retail packaging and, in part, thereby failing to include directions for use and a warning or caution statement as required by regulations promulgated under FIFRA. This enforcement action is protective of human health, a central goal of FIFRA. The Maryland Department of Agriculture was provided notice of the planned enforcement action and had no objections. The settlement required the respondent to certify compliance with applicable FIFRA requirements and to pay a $6,100 penalty.
