On November 5, 2024, EPA entered into an expedited settlement agreement (Agreement) with Onyx Corporation, addressing alleged violations of the General Permit for Discharges from Construction Activities (CGP) at a residential development located in Amesbury, Massachusetts. An EPA inspection at 24 South Hunt Road in Amesbury, Massachusetts revealed that the Permittee had failed to post a sign indicating CGP coverage and failed to maintain erosion controls. Pursuant to the Agreement, Onyx Corporation will pay a $1,500 penalty. While EPA implements the National Pollutant Discharge Elimination System program in Massachusetts, the case team consulted with the Massachusetts Department of Environmental Protection on this matter.
