Helena Agri-Enterprises, LLC: 10/23/2024 FIFRA Notice of Warning Case File No. FIFRA-04-2025-3818 The U.S. Environmental Protection Agency has obtained evidence indicating that Helena Agri-Enterprises, LLC (herein Helena Agri-Enterprises) appears to be in violation of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). The language of the collected label appears to be from an older label accepted on July 6, 2010, and not the most recent label that was accepted on November 12, 2014, in apparent violation of 40 C.F.R. ? 152.130. Additionally, the product label did not contain directions for use which are necessary for effecting the purpose for which the product is intended and is therefore misbranded pursuant to FIFRA Section 2(q)(1)(F). Therefore, Helena Agri Enterprises has been selling and distributing Sol-Oil 97 as a misbranded pesticide in apparent violation of FIFRA Section 12(a)(1)(E). Pursuant to FIFRA Sections 12(a)(1)(E), 7 U.S.C. ? 136j(a)(1)(E) it shall be unlawful for any person in any State to distribute or sell to any person any pesticide which is adulterated or misbranded. Pursuant to 40 C.F.R. ? 152.130(a), a registrant may distribute or sell a registered product with the composition, packaging and labeling currently approved by the Agency.
