DECEMBER 2, 2024 - ADMINISTRATIVE ORDER ON CONSENT


1On October 10, 2023, the EPA and MDEQ conducted a Compliance Evaluation Inspection (CEI) to assess the overall operation of the Facility. The CEI identified violations of the Operations and Maintenance Requirements Section of the 2019 NPDES Permit. The EPA's finding and recommendations were summarized in a CEI Report dated November 20, 2023.

In May 2024, the EPA reviewed its Integrated Compliance Information System (ICIS). The  review identified violations of the Effluent Limits and Monitoring Requirements Section of the 2019 NPDES Permit. Specifically, the County violated the effluent limitations for 5-day Biochemical Oxygen Demand (5 counts), Total Suspended Solids (3 counts), Flow (2 count ), and E.coli (8 counts) as indicated in the discharge monitoring reports (DMRs) during the period covering January 1, 2020, through April 30, 2024.

On July 2, 2024, the EPA sent a Notice of Violations (NOV) to the City regarding violations identified during the CEI and ICIS review. The NOV noted Effluent Limitation and Monitoring violations and Proper Operation and Maintenance violations of the 2019 NPDES Permit.

Based on the above, the EPA finds that the City is in violation of Section 301(a) of the CWA, 33 U.S.C. ? 1311(a}, and the above referenced provisions of its 2019 NPDES Permit.
