On December 23, 2024, Region 1 filed a Consent Agreement and Final Order (CAFO) resolving violations of the Toxic Substances Control Act, the Residential Lead-Based Paint Hazard Reduction Act and the Lead-Based Paint Disclosure Rule (Disclosure Rule) alleged against Dwight RE, LLC of New Haven, Connecticut. Dwight RE, LLC owns and offers for lease at least 13 target housing buildings totaling 63 units in New Haven, Connecticut. Respondent did not provide proper disclosure to the tenants of eight apartments before they became obligated to lease units in the building, including: by failing to provide lessees with EPA-approved lead hazard pamphlets; by failing to include statements disclosing the presence of known lead-based paint and/or hazards; and by failing to include lists of records/reports pertaining to lead-based pain or lead-based paint hazards in the housing. The CAFO requires Respondents to pay a penalty of $41,322. The properties at issue are located in an area of environmental justice concern.
