Summary

On January 16, 2025, EPA entered into an administrative order on consent (Order) with Old Dutch Mustard Co., Inc. d/b/a Pilgrim Foods, Inc. (Pilgrim Foods) to address alleged unauthorized discharges of pollutants to waters of the United States. Pilgrim Foods is a manufacturer of vinegar and mustard products in Greenville, New Hampshire. EPA found that Pilgrim Foods violated Section 301(a) of the Clean Water Act (CWA) by discharging pollutants, in the form of low-pH discharges, to an unnamed stream that flows into the Souhegan River. The Order requires Pilgrim Foods to conduct: 1) a Facility Engineering Investigation to determine the causes of the unauthorized discharges, 2) a Facility Environmental Site Assessment and Investigation to determine the sources of any noncompliance with the CWA, and 3) a Comprehensive Environmental Compliance Plan so as to eliminate any further CWA violations. It also requires continued instream monitoring. EPA has coordinated with the New Hampshire Department of Environmental Services on this action.
