On January 16, 2025, EPA issued a Notice of Warning to Kuther Air Service for misusing a registered pesticide under Section 12 of the Federal Insecticide, Fungicide and Rodenticide Act. An inspection, conducted by a federally credentialed tribal inspector on June 22, 2023, showed that the Respondent aerially applied an insecticide to a field of black peas at higher concentration than directed by label requirements for Nufarm Lambda-Cyhalothrin 1EC Insecticide, EPA Reg. No. 228-708.
