On May 14, 2025, Region 10 filed an expedited settlement agreement resolving CWA violations of the state of Washington?s Industrial Stormwater General Permit by Wilbur Ellis Company at its facility in Mount Vernon, Washington. Alleged violations included failure to sample and monitor, failure to maintain structural controls and measures, failure to minimize exposure through good housekeeping practices, failure to conduct routine site inspections, failure to take corrective actions, failure to maintain a Stormwater Pollution Prevention Plan according to the written standard, and failure to report and maintain records as required by the permit. This enforcement action stands to prevent an annual discharge of 473 pounds of Biological Oxygen Demand, 495 pounds of Chemical Oxygen Demand, 42 pounds of Nitrate + Nitrite Nitrogen, 56 pounds of Total Nitrogen, 5 pounds of Total Phosphorus, and 2,001 pounds of Total Suspended Solids into Padilla Bay. The Respondent agreed to pay a penalty of $8,606, and has returned to compliance.
