Carmeuse Lime owns and operates a lime manufacturing facility in Bettsville, Ohio. Following a January 2020 inspection of the facility, EPA alleged that Carmeuse violated exceeded the sulfur dioxide (SO2) emissions limits at two of its kilns set forth in its Title V Operating Permit.
EPA has entered into a Consent Agreement and Final Order (CAFO) and an Administrative Compliance Order (ACO) with Carmeuse to resolve the alleged violations. As an interim measure under the ACO, Carmeuse will conduct daily mass balance calculations in order to demonstrate compliance with its SO2 emissions limits. As final compliance measures under the ACO, Carmeuse will (1) comply with a new, lower SO2 emission limit; (2) apply for a permit to incorporate the new limit; and (3) install and operate a continuous emissions monitoring system for SO2 in order to demonstrate compliance with the SO2 emission limit. The compliance measures will reduce SO2 emissions from the facility by over 3,000 tons and will also result in over 50,000 tons of greenhouse gas emission reductions, calculated as carbon dioxide equivalents. In the CAFO, Carmeuse agreed to resolve EPA?s penalty claims by paying a penalty of $260,000.
