On 1/31/25, EPA Region 6 issued a formal Notice of Warning (NOW) to H2Enviro Upstream LLC for its facility in Midland, TX. The NOW was issued for an alleged violation of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), for failure to file a pesticide production report (EPA Form 3540-16) for the EPA-registered establishment 93484-TX-1 for 2023, as required by Section 7(c) of FIFRA, 7 U.S.C. Section 136e(c).
