On February 10, 2025, EPA issued a Clean Water Act (CWA) administrative order (Order) to the Merrill Excavating, Inc. in Salem, New Hampshire for failure to submit discharge monitoring reports (DMRs) pursuant to their CWA National Pollutant Discharge Elimination System permits. The facility was authorized to discharge under the Multi-Sector General Permit. The Order requires the permittee to submit all outstanding DMRs and continue reporting as required by their permits. While EPA is responsible for implementing the Clean Water Act in New Hampshire, EPA notified New Hampshire Department of Environmental Services of these actions.
