The EPA conducted an inspection of the Facility from May 16 to May 20, 2022, to determine Respondent?s compliance with Section 112(r) of the CAA, 42 U.S.C. ? 7412(r), and 40 C.F.R. Part 68. On August 17, 2023, the EPA sent the Respondent a Notice of Potential Violation and Opportunity to Confer letter. On January 18, 2024, the EPA met with the Respondent as a result of the opportunity to confer and articulated the EPA?s position concerning the Respondent?s compliance with Section 112(r) of the CAA, 42 U.S.C. ? 7412(r) regarding the Inspection. On multiple occasions, the EPA requested, and the Respondent provided, further documentation and information concerning Respondent?s compliance with Section 112(r) of the CAA, 42 U.S.C.? 7412(r), and 40 C.F.R. Part 68.
