EPA hereby issues this Notice of Determination (NOD) regarding violations voluntarily disclosed to EPA on 3/17/2022 by Chesapeake
Energy Corporation (Chesapeake) for 281 facilities acquired from Vine Energy located in Northern Louisiana. The violations were identified during a new owner audit conducted beginning 8/01/2022. The audit was completed by 3/31/2023. EPA approved the requests in July 14 and July 21, 2022, correspondence to extend the timeline to complete the corrective actions outlined therein. The final audit report was submitted to EPA on 4/24/2023. Based on the review of information and documentation received and in reliance on the Chesapeake certifications, EPA has determined Chesapeake has met all of the conditions of the New Owner Audit Policy and is eligible for a waiver of the total gravity-based civil penalty for the disclosed violations. Chesapeake accrued no significant economic benefit of noncompliance as a result of the violations described herein, and this NOD resolves the civil penalty liability for the violations described herein with no assessment of a civil penalty.
