On April 9, 2025, EPA Region 6 issued a Notice of Warning and Notice of Intent to Terminate under its authority pursuant to Section 9(c)(3) of FIFRA, 7 U.S.C. Section 136g(c)(3) and 40 C.F.R. Section 167.20(f) to Denton Protein Feed, LLC. The Notice of Warning and Notice of Intent to Terminate was issued in response to alleged violations of Section 12(a)(2)(L) of FIFRA, 7 U.S.C. Section 136j(a)(2)(L), for Denton Protein Feed's failure to file annual pesticide production reports for the years 2020 through 2024 for its EPA-registered establishment 90960-TX-1, located in Wingate, TX. The Notice of Warning and Notice of Intent to Terminate requires Denton Protein Feed, LLC to submit the missing annual pesticide production reports within 30 calendar days from the date of this notification. Denton Protein Feed, LLC must respond to EPA Region 6 within 30 days of the issue date.
