On April 17, 2025, EPA issued a Notice of Warning (NOW) to a pesticide distribution company based in Massachusetts, ERC Wiping Products. The NOW addressed the company's sale and promotion of an unregistered product using pesticidal claims and implications. The use of pesticidal claims in connection with the sale or distribution of a product require that product to be registered with EPA. FIFRA Section 12(a)(1)(A), 7 U.S.C. 136j(a)(1)(A) prohibit the distribution and sale of a pesticide product that is not registered as a pesticide by EPA. The NOW stated that the company had thirty (30) calendar days to submit a statement of corrective actions the company has taken, or plans to take, to address the alleged FIFRA violations. The Massachusetts Department of Agricultural Resources was notified of the issuance of the NOW.
