On February 25, Region 3 issued an Expedited Settlement Agreement (ESA) to Erie Plating Company for violations of RCRA Subtitle C and Pennsylvania's federally-authorized hazardous waste program, in connection with the facility located in Erie, Pennsylvania. A compliance evaluation inspection of the facility, in coordination with PADEP, took place on 9/6/25-9/7/25. The violations in the settlement include failure to make a hazardous waste determination, failure to maintain a satellite accumulation area (SAA) container at the point of generation, failure to close SAA containers of hazardous waste when not adding or removing wastes, failure to keep a container of hazardous waste closed at all times except when adding or removing wastes, failure to label containers of hazardous waste with the words Hazardous Waste , failure to mark containers of hazardous waste with the start accumulation date, failure to provide documentation to show that waste filters going for reclamation were not being speculatively accumulated, and failure to keep universal waste lamp containers closed. Per the terms of the ESA, Erie Plating Company will pay a civil penalty of $10,000.00.
