The facility failed to report to EPCRA Section 313 Toxics Release Inventory for its coincidental manufacture of Nitrate Compounds for reporting years 2020 and 2021. A significant quantity of Nitric Acid (a TRI regulated chemical for which the facility did submit TRI reports) was neutralized on-site for wastewater pH adjustment using an alkaline chemical. That neutralization reaction coincidentally manufactures Nitrate Compounds as an aqueous byproduct reportable to TRI. The facility had not reported to TRI that 33,626 pounds in 2020 and 56,576 pounds in 2021 of Nitrate Compounds in aqueous solution had been discharged to the local POTW. The facility has come into compliance by submitting the Nitrate Compounds forms. The facility will pay a monetary penalty of $45,400.
