On April 25, 2025, EPA Region 1 issued a Clean Air Act ( CAA ) Administrative Compliance Order on Consent ( Order ) to G. Lopes Construction, Inc. ( G. Lopes ). G. Lopes operates two fixed nonmetallic mineral processing plants at their facility, located in Raynham, Massachusetts. The Order addresses G. Lopes' alleged violations of the New Source Performance Standards ( NSPS ), specifically the NSPS for Nonmetallic Mineral Processing Plants, 40 C.F.R. S 60.670 - 60.676 ( Subpart OOO ). Under the Order, G. Lopes has six months to conduct an emissions test and come into compliance with Subpart OOO. MassDEP does not have authorization for these standards. EPA conducted an inspection of the facility and identified violations of this federally enforceable standard.
