On June 6, 2025, Region 1 settled an administrative penalty order against Webco Chemical Corporation ( Webco ). The order alleged violations of Section 313 of the Emergency Planning and Community Right-to-Know Act ( EPCRA ). Webco operates a chemical blending and repackaging facility in Dudley, MA (the Facility ). The Consent Agreement and Final Order ( CAFO ) in the EPCRA case alleges that Webco violated EPCRA Section 313 and its implementing regulations by failing to file TRI reports for nitric acid processed at the Facility in calendar years 2019, 2020, and 2021, and for nonylphenol ethoxylates ( NPE ) in calendar years 2020 and 2021. The CAFO requires Webco to pay a civil penalty of $74,159 and complete a Supplemental Environmental Project ( SEP ) by donating emergency equipment to the Town of Dudley Fire Department. EPCRA?s TRI reporting program is a nondelegated federal program enforced only by EPA. Enforcement of EPCRA's reporting requirements ensures that communities are not deprived of their right to know about chemicals used, stored, or released within their vicinity that may affect public health and the environment. The NPDES program has not been delegated to Massachusetts.
