On June 11, 2025, EPA Region 3 filed a Consent Agreement and Final Order (CAFO) simultaneously commencing and concluding an administrative action against Pencader Realty, LLC (Respondent) for alleged violations of EPA?s TSCA 1018 Lead Disclosure Rule in connection with multiple pre-1978 leased housing units in Wilmington, DE. The alleged violations include failing to include, either as within or as an attachment to nine lease agreements, a statement by the lessee affirming receipt of the lead hazard information and the Protect Your Family From Lead in Your Home pamphlet; and failing to include in eight lease agreements or as an attachment to those agreements, signatures of the lessor and lessee certifying accuracy of their statements, along with the dates of signature. These requirements ensure that individuals and families receive information necessary to protect themselves from lead-based paint and/or lead-based paint hazards and are in a position to make informed decisions to reduce the risk of exposure to lead-based paint and/or lead-based hazards. Per the terms of the CAFO, Respondent will pay a civil penalty in the amount of $15,907. The Delaware Department of Health and Social Services was notified and did not object to this action.
