June 11, 2025, Region III filed a Consent Agreement and Final Order regarding fifty-four (54) violations of Section 112 of the CAA, 42 U.S.C. 7412, for failing to monitor valves in accordance with 40 C.F.R. 63.168(d)(2), and 40 C.F.R 63.2480.   This enforcement action addresses the CAA's Section 112 purpose of reducing the emissions of hazardous air pollutants in furtherance of the Administrator's Pillar of providing every American with access to clean air, land, and water. EPA became aware of these violations through its collection and review of leak detection and repair monitoring data.  The Consent Agreement alleges that Allnex USA, Inc. violated the CAA by failing to monitor valves in its urethanes manufacturing unit. Under the terms of the settlement, Allnex USA, Inc. will pay a civil penalty in the amount of $34,365.00 to resolve these fifty-four (54) violations.  EPA notified the West Virginia Department of Environmental Protection regarding this matter, and the West Virginia Department of Environmental Protection has raised no objections.
