On June 11, 2025, EPA Region 3 filed a Consent Agreement and Final Order (CAFO) simultaneously commencing and concluding an administrative action against Forman Design, Inc., d/b/a CertaPro Painters of Fairfax, Prince William, and Northern Virginia (Respondent) for alleged violations of EPA's TSCA Lead-Based Paint Renovation, Repair and Painting (RRP) rule, 40 C.F.R. Part 745, Subpart E, in connection with the renovation of a residential property located in Virginia. The alleged violations include failing to obtain initial certification to perform renovations and failing to make available to EPA records necessary to demonstrate compliance with the RRP work practice standards and post-renovation cleaning verification requirements of 40 C.F.R. 745.85. These requirements protect the public from lead-based paint hazards associated with renovation, repair, and painting activities. Per the terms of the CAFO, Respondent will pay a civil penalty in the amount of $4,617. The Commonwealth of Virginia Department of Labor and Industry was notified and did not object to this action.
