## Summary

On February 4, 2023, Mexican Products attempted to import HFCs illegally into the United States via the port of Roma, Texas. On March 15, 2023, EPA performed an investigation of HFC smuggling by Mexican Products, to evaluate five gas cylinders collected for the presence of refrigerant gases to determine compliance with the AIM Act. A lab analysis performed by EPA, confirmed the presence of HFCs in the five cylinders, 2,391.6 total pounds. The attempted illegal import is a violation of 40 CFR 84.5(b)(1). For issuing the resulting penalty CAFO, the Respondent, without expending allowances, imported approximately 2,088 total MTEVe HFC using the formula prescribed by 40 CFR 84.3. Respondent did not possess any allowances when importing these bulk HFCs; therefore, these bulk regulated substances were imported in violation of 40 CFR 84.5(b)(1).
