Consent Agreement and Final Order involving a penalty of $145,000 and terms to resolve the Respondents' failure to maintain compliance with PREPA Palo Seco Steam Power Plant (Mobile Pacs) air emission source permit, the NSPS Subpart KKKK and NESHAP Subpart YYYY. Among the compliance issues to be resolved by this agreement are the failure to comply with the Mobile Pacs fuel consumption limit, failure to meet the NESHAP Subpart YYYY annual performance testing requirements, and to meet the reporting requirements established by the NSPS Subpart KKKK and NESHAP Subpart YYYY. The Respondents agreed, among other actions, to submit all past due semi-annual compliance reports required under the NSPS Subpart KKKK and NESHAP Subpart YYYY, submit the parameter monitoring plan required under the NSPS Subpart KKKK and to post all NESHAP Subpart YYYY and NSPS Subpart KKKK compliance monitoring reports to their public-facing website.
