An Notice of Determination was Issued Regarding Violations of FIFRA Voluntarily Disclosed to EPA by Energy Solutions USA, LLC of Princeton, NJ
On June 11, 2025, EPA issued an Notice of Determination to Energy Solutions USA, LLC (?Energy Solutions?) for violations of Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) requirements. Energy Solutions violated Section 12(a)(1)(C) of FIFRA by engaging in distribution or sale of the registered pesticides, ?Tolicide 4FRAC?, ?Tolcide 4FRAC20? and ?Tolcide 4FRAC20W? with compositions that differed from the composition Energy Solutions had provided to EPA. Specifically, Energy Solutions had been using a source of Alkyl Dimethy Benzyl Ammonium Chloride not listed on the Confidential Statements of Formula (CSF) associated with their product registrations; Energy Solutions sold these pesticide products with compositions which had not been approved by EPA. Energy Solutions disclosed these violations and returned to compliance. EPA determined that Energy Solutions met all of the conditions in the Audit Policy and is eligible for a waiver of the total gravity-based civil penalty for the disclosed violations. (C.
