On August 4, 2025, EPA-Region 1 entered into an expedited settlement agreement (Agreement) with Black Brook Realty Properties, LLC, addressing violations of the Construction General Permit for Stormwater Discharges from Construction Activities (CGP) at the Cobbler's Creek site in Upton, Massachusetts. On April 17, 2025, EPA Region 1 conducted an inspection at Cobbler's Creek and observed that Respondent had been constructing a residential development and discharging stormwater with having obtain CGP coverage. The company obtained CGP coverage shortly after the inspection. Pursuant to the Agreement, Black Brook Realty Properties, LLC will pay a $4,800 penalty. EPA implements the National Pollutant Discharge Elimination System program in Massachusetts. The case team consulted with the Massachusetts Department of Environmental Protection on this matter.
