On July 24, 2025, Region 3 entered a Consent Agreement and Final Order with Built Not Bought Automotive, LLC ( BNB ) that initiated and resolved alleged violations of the CAA and its implementing regulations related to aftermarket defeat devices. The violations arise out of BNB selling defeat devices, including hundreds of Exhaust Gas Recirculation Deletes and Exhaust Aftertreatment Delete Hardware (e.g., straight pipes), and hundreds of other parts designed to disable emission controls or emission-related elements of design for cars and diesel trucks, from at least January 2019 through March 2022. Such violations frustrate the implementation of regulatory programs designed to reduce emissions of harmful air pollutants, a goal of the CAA, and this enforcement action is in furtherance of Administrator Zelden's Pillar 1: Clean Air, Land, and Water for Every American. Based on a review of financial information, and the conclusion that BNB had no ability to pay the calculated penalty, this settlement does not involve a penalty payment. The settlement required BNB to certify compliance with applicable CAA requirements. VADEQ was provided notice of the planned enforcement action and had no objections.
