Summary

On August 19, 2025, EPA Region 1 ( EPA ) filed a Consent Agreement and Final Order ( CAFO ) resolving an action against Affordable Vinyl Windows & Siding, Inc. ( Respondent ) for alleged violations of TSCA's Lead-Based Paint Requirements and the Lead Renovation, Repair and Painting Rule ( RRP Rule ). Based on information obtained during EPA's inspection of Respondent's business in Auburn, New Hampshire, EPA identified multiple alleged RRP Rule violations. Respondent allegedly failed to: stop performing renovation work on pre-1978 residential properties until obtaining firm recertification; ensure certified renovators perform/train/direct renovations; retain records for 3 years; and provide unit owners with the Renovate Right pamphlet. The properties were vacant at the time of renovations. Under the CAFO, which initiated and concluded EPA's enforcement action simultaneously, Respondent will pay a penalty of $34,082. Respondent has also corrected the alleged RRP Rule violations. The RRP Rule is not delegated to the State, but the New Hampshire Department of Health and Human Services' Lead Program has been made aware of this case.
