On September 26, 2023, the EPA conducted an inspection at Respondent?s facility, which is subject to the 40 CFR Part 68 Program 2 prevention requirements. Respondent was found in violation of these requirements, and also failed to ensure and document that the process is designed in compliance with recognized and generally accepted good engineering practices for anhydrous ammonia retailers. The order requires compliance with these requirements.
