On August 21, 2025, EPA Region 3 filed a Consent Agreement and Final Order ( CAFO ), concluding an administrative proceeding with HYDAC Corporation ( HYDAC ) located at 90 Southland Drive, Bethlehem, Pennsylvania 18017 ( Facility ) for violations of the Resource Conservation and Recovery Act ( RCRA ) and the authorized Pennsylvania Hazardous Waste Management Regulations, discovered during EPA's compliance inspection of the Facility on March 06, 2024. Under RCRA, EPA has authority to manage hazardous waste from cradle-to-grave including generation, transportation, treatment, storage and disposal of hazardous waste. HYDAC generated hazardous waste through the manufacturing processes which include solvent and solvent-contaminate waste. The violations in the CAFO include 1) operate without a permit or interim status, 2) failure to notify as a large quantity generator of hazardous waste, 3) failure to keep containers of hazardous waste closed when not adding or removing waste, 4) failure to properly label container, and failure to demonstrate length of time of accumulation of universal waste, 5) open container, failure to label a container, and failure to demonstrate the length of time of accumulation of universal waste lamps, 6) failure to provide annual refresher training, and 7) failure to submit biennial reports. Region 3 notified PADEP, which had no objections to this action. Per the terms of the CAFO, HYDAC will pay a civil penalty in the amount of $74,000.00. This action
