On September 2, 2025, EPA-Region 1 entered into an expedited settlement agreement (Agreement) with Horne's Pond Real Estate Group, LLC, addressing violations of the General Permit for Discharges from Construction Activities (CGP) at the 35 Maple Street site in Derry, New Hampshire. On May 1, 2025, EPA Region 1 conducted an inspection at 35 Maple Street and observed sediment from the site entering an offsite catch basin that flows into a nearby surface water and leaving the site via trackout. The site also failed to post notice of Construction General Permit coverage and failed to conduct and document required inspections properly. Pursuant to the Agreement, Horne's Pond Real Estate Group, LLC will pay a $6,780 penalty. EPA implements the National Pollutant Discharge Elimination System program in New Hampshire. The case team consulted with the New Hampshire Department of Environmental Services on this matter.
