On August 21, 2025, Region 1 filed an Expedited Settlement Agreement (ESA) resolving violations of the Toxic Substances Control Act, and the Massachusetts Deleading and Lead-Safe Renovation Regulations (MA RRP Rule) alleged against Wesley and Marcelo Home Improvement Inc. (Respondent) of Centerville, Massachusetts. The MA RRP Rule was promulgated by Massachusetts as part of a federally approved State program authorized by the Administrator in accordance with Section 404 of TSCA, 15 U.S.C. 2684. Wesley and Marcelo Home Improvement Inc. ( WMHI ) provides residential property renovation services such as carpentry, drywall repair and window replacement. Responses to an information request and an inspection revealed that WMHI had performed a renovation subject to the MA RRP Rule in military housing at Hanscom Air Force Base. WMHI did not obtain initial firm certification from Massachusetts, and failed to retain records for three years following completion of the renovations. The ESA requires Respondent to pay a penalty of $2,000 and certify compliance with the MA RRP Rule. Massachusetts has been notified of this action.
