On March 15, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Tesoro Logistics Operations LLC (Respondent) for its oil storage and distribution terminal in Vancouver, Washington. Respondent failed to have adequate sized secondary containment for its terminal tank farm and the Respondent's SPCC Plan had inadequate general secondary containment provisions addressing failure evaluation scenarios and general secondary containment for process piping located outside the tank farm. Respondent completed a tank farm dike reconstruction project in November 2023 correcting the sized secondary containment violation. June 2025 SPCC Plan revisions addressed other identified plan violations related to the failure evaluation documentation and general secondary containment deficiencies for process piping. Respondent's terminal is 2000 feet from the Columbia River, a major water transportation corridor in the Portland, Oregon harbor area and an environmentally sensitive water body. The Respondent has agreed to pay a penalty of $99,000 and has returned to compliance. The estimated cost of the tank farm reconstruction is $670,000.
