This Administrative Compliance Order is issued to the Town for violations of the NYSDEC SPDES General Permit for Stormwater Discharges from Municipal Separate Storm Sewer Systems (MS4s). Violations include failure to update the Stormwater Management Program Plan to include all required information; failure to develop, implement and enforce a construction oversight program; failure to ensure construction site inspectors receive required training before conducting inspections; failure to ensure construction site inspections are documented as required by the Permit; failure to maintain required information in construction and post-construction stormwater management practice inventories; and; failure to update and implement a post-construction stormwater management practice inspection and maintenance program. The Order includes a compliance schedule requiring the Town to address deficiencies identified during EPA's April 30, 2025, May 1, 2025, and May 13, 2025 MS4 audit.
