On September 9, 2025, EPA filed a Consent Agreement and Final Order in which E.L. Harvey & Sons, Inc., Trojan Recycling, Inc., Nauset Disposal Holdings, Inc., and Arrowhead Environmental Partners LLC ( Respondents ) will pay a total penalty of $170,000 for discharges of stormwater without authorization under the National Pollutant Discharge Elimination System (NPDES) Multi-Sector General Permit (MSGP) for Stormwater Discharges Associated with Industrial Activity at seven facilities in Massachusetts. EPA conducted inspections of Respondents' waste and recycling processing facilities, which also include vehicle maintenance at some of their sites, in New Bedford and Brockton, Massachusetts in the fall of 2023. Based on EPA's information gathering, seven Massachusetts facilities were discharging stormwater into waters of the United States without Permit authorization. After EPA's inspections, Respondents obtained MSGP coverage for all seven facilities. The Region coordinated with the Massachusetts Department of Environmental Protection on this case.
