Summary

EPA Region 1 Settles CAA Penalty Case with American GreenFuels, LLC, in New Haven, Connecticut On September 3, 2025, EPA Region 1 settled an administrative penalty action against American GreenFuels, LLC ( AGF ) for an alleged violation of the Clean Air Act ( CAA ) that occurred at AGF's biodiesel production facility located in New Haven, Connecticut. AGF's facility is subject to the General Provisions of the Standards of Performance for New Stationary Sources, 40 C.F.R. Part 60, Subpart A. AGF violated emission control requirements under Subpart A by failing to maintain and operate the facility in a manner consistent with good air pollution practices for minimizing emissions. For a period of two years, approximately every two weeks for an average of 11 hours at a time, AGF bypassed its emissions control device to conduct cleaning and maintenance. The production process was not necessarily halted during these events, resulting in uncontrolled emissions of volatile organic compounds (VOCs) including methanol which is a hazardous air pollutant. EPA and AGF settled the case with a Consent Agreement and Final Order ( CAFO ) that both initiated and concluded the action with AGF agreeing to pay a settlement penalty of $143,000. All compliance issues have been resolved as of the filing of the CAFO. The case is part of the Air Toxics National Enforcement and Compliance Initiative ( NECI ).
