Notice of Warning for Violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA)

The U.S. Environmental Protection Agency regulates the registration, distribution, sale, and use of pesticide products pursuant to the provisions of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA or the Act), as amended, 7 U.S.C. ?? 136 et seq. The EPA is issuing this Notice of Warning (NOW) to Southeastern Minerals, Inc. (hereinafter Southeastern Minerals), pursuant to Section 14(a)(4) of FIFRA. As explained below, the EPA finds that Southeastern Minerals violated FIFRA Section 12(a)(1)(A) by distributing or selling unregistered pesticides.
The EPA registered pesticide, Clarifly Concentrate 8% (EPA Reg. No. 270-379-89459) is custom blended into feed mineral products for ABC Nutrition Service, Inc. to make SSC Breeder Special Fescue w/DFBZ, SSC Breeder 8 Mg Special Fescue w/DFBZ, SSC Breeder 8 Mg w/DFBZ, SSC Cattle Pro 4 w/DFBZ, SSC Breeder 4P w/DFBZd products. These products are not kept in inventory and according to the statement from Southeastern Minerals, these custom blend products are distributed either directly to the customers of ABC Nutrition Services, Inc, or, shipped to a commercial loading dock called Neville Hardware at ABC Nutrition Service, Inc.?s request solely to reduce transportation costs.
