ALLEGED VIOLATIONS:
ON MARCH 27, 2024, AN INSPECTOR WITH THE EPA ATTEMPTED TO CONDUCT AN INSPECTION AT RESPONDENT?S PLACE OF BUSINESS LOCATED AT 2615 HARVEY AVENUE, NORTH CHARLESTON, SOUTH
CAROLINA 29404, FOR THE PURPOSE OF EVALUATING RESPONDENT?S COMPLIANCE WITH THE REQUIREMENTS OF 40 C.F.R. PART 745, SUBPART F. UPON ARRIVAL, NO ONE WAS PRESENT AT RESPONDENT?S OFFICE. THE INSPECTOR LEFT A NOTICE OF INSPECTION IN RESPONDENT?S MAILBOX AND LATER EMAILED RESPONDENT AND
REQUESTED THAT RESPONDENT PROVIDE RECORDS THAT WOULD HAVE BEEN REVIEWED BY THE INSPECTION IF THE IN-OFFICE INSPECTION HAD OCCURRED. ON AUGUST 7, 2024, RESPONDENT SUBMITTED RECORDS TO THE EPA VIA EMAIL FOR REVIEW TO EVALUATE ITS COMPLIANCE WITH 40 C.F.R. PART 745, SUBPART F.
BASED ON A REVIEW OF RESPONDENT?S RECORDS, THE EPA DETERMINED THAT ON OR ABOUT JUNE 29, 2023, RESPONDENT HAD ENTERED INTO A CONTRACT TO LEASE THE RESIDENTIAL DWELLING AT 62 REID STREET, CHARLESTON, SOUTH CAROLINA 29403, WHICH WAS BUILT IN 1840 AND IS ?TARGET HOUSING? AS DEFINED IN 40 C.F.R. ? 745.103. BASED ON A REVIEW OF THE RECORDS, THE EPA ALLEGES THAT RESPONDENT, ACTING IN ITS CAPACITY AS AN AGENT FOR THE LESSOR, FAILED TO INCLUDE AS AN ATTACHMENT OR WITHIN THE CONTRACT
TO LEASE TARGET HOUSING, THE APPROPRIATE LEAD WARNING STATEMENT, IN VIOLATION OF 40 C.F.R. ? 745.113(B)(1).
