9/11/2025 - CONSENT AGREEMENT AND FINAL ORDER ISSUED ASSESSING A PENALTY OF $2,800.00 TO BE PAID IN 30 DAYS AFTER THE EFFECTIVE DATE OF THIS CAFO.
ALLEGED VIOLATIONS:
ON JUNE 6, 2024, AN INSPECTOR WITH THE EPA CONDUCTED AN INSPECTION AT RESPONDENT?S PLACE OF BUSINESS LOCATED AT 1 CHICK SPRINGS ROAD, SUITE 301-B, GREENVILLE, SOUTH CAROLINA 29609, AND REQUESTED COPIES OF RECORDS ON AUGUST 22, 2024, FOR THE PURPOSE OF EVALUATING RESPONDENT?S COMPLIANCE WITH THE REQUIREMENTS OF 40 C.F.R. PART 745, SUBPARTS E AND F. SUBSEQUENT TO EPA?S REQUEST, ADDITIONAL RECORDS TO EVALUATE COMPLIANCE WERE SUBMITTED BY THE RESPONDENT ON SEPTEMBER 4, 2024, AND MAY 22, 2025.
BASED ON THE EPA?S REVIEW OF RESPONDENT?S RECORDS AS DESCRIBED IN SECTION IV OF THE CAFO, THE EPA ALLEGES THAT:
- RESPONDENT, IN ITS CAPACITY AS AN AGENT CONCERNING THE LEASING OF TARGET HOUSING DESCRIBED IN PARAGRAPH 28, FAILED TO INCLUDE AS AN ATTACHMENT OR WITHIN THE LANGUAGE OF THE CONTRACT TO LEASE TARGET HOUSING A LIST OF ANY RECORDS OR REPORTS AVAILABLE TO THE LESSOR PERTAINING TO LEAD-BASED PAINT AND/OR LEAD-BASED PAINT HAZARDS IN THE HOUSING THAT HAD BEEN PROVIDED TO THE LESSEE, OR A STATEMENT INDICATING THAT NO SUCH RECORDS OR REPORTS WERE AVAILABLE, IN VIOLATION OF 40 C.F.R. ? 745.113(B)(3).
- IN THE COURSE OF THE RENOVATION OF THE PROPERTIES SET FORTH IN PARAGRAPH 30, RESPONDENT, IN ITS CAPACITY AS A FIRM, FAILED TO APPLY TO THE EPA AND OBTAIN FIRM CERTIFICATION TO PERFORM, OFFER, OR CLAIM TO PERFORM RE
