On September 16, 2025, EPA Region 3 entered into a Consent Agreement and Final Order with Multi-Flex Plating Company ( Multi-Flex ), the owner and operator of a plating and polishing facility located in Collingsdale, Pennsylvania ( Facility ). The Facility is subject to both 40 C.F.R. Part 63 Subpart N, National Emission Standards for Hazardous Air Pollutants for Chromium Emissions from Hard and Decorative Chromium Electroplating and Chromium Anodizing Tanks ( Subpart N ) and 40 C.F.R. Part 63 Subpart WWWWWW, National Emission Standards for Hazardous Air Pollutants for Area Source Standards for Plating and Polishing Operations ( Subpart 6W ). The EPA obtained information as part of its investigation showing that Multi-Flex had failed to prepare and retain annual compliance status reports in violation of 40 C.F.R. Part 63, Subpart N and annual certification of compliance reports in violation of 40 C.F.R. Part 63, Subpart 6W from at least August 2020 to March 2025. The Consent Agreement did not include a penalty, as Region 3 determined that Multi-Flex has no financial means to pay a penalty. This case seeks to ensure that facilities working with hazardous air pollutants comply with applicable federal work practice, reporting and record keeping requirements, minimizing the risk of potential harm to neighboring communities and the environment.
