On July 8, 2025, EPA Region 1 filed an Expedited Settlement Agreement (ESA) resolving violations of the Resource Conservation and Recovery Act (RCRA) alleged against Smith & Nephew (Respondent) of Mansfield, Massachusetts. Smith & Nephew, which is a large quantity generator of hazardous waste, manufactures medical devices for sports medicine surgery at its Mansfield, MA facility where it conducts machining, metal welding, and electropolishing. EPA found (among other concerns) that Smith and Nephew failed to perform a hazardous waste tank assessment that was assessed and reviewed by an individual with the appropriate credentials, failed to perform certain tank inspections, and failed to provide revisions of the contingency plan to the local authorities. The ESA requires the company to pay a penalty of $12,500 and certify compliance with RCRA requirements. EPA notified the Massachusetts Department of Environmental Protection of this action.
