On September 23, 2025, EPA Region 3 filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative action GnG VA006, Inc. (Respondent) for violations of RCRA Subtitle I and the Commonwealth of Virginia's federally authorized underground storage tank program at the Respondent's Spirit Convenience Store facility located at 6862 W. Lee Highway, in Rural Retreat, Virginia 24368 (Facility). Based on observations made during an inspection on April 17, 2024, the violations alleged include: (i) Failure to Conduct Tank Release Detection At Least Every 30 Days; and (ii) Failure to Perform Walkthrough Inspections Every 30 Days. The settlement involves no penalty payment based on EPA's determination that Respondent has no financial means to pay a penalty. The EPA notified the Virginia Department of the Environmental Quality of this action on September 13, 2024, and did not raise any objections.
