Summary

Carmeuse Lime, Inc., Grand River, OH violated the National Emission Standards for Hazardous Air Pollutants for Lime Manufacturing Plants (the LMP NESHAP). Specifically, the LMP NESHAP requires Carmeuse to operate the stack for its lime kilns below 15% opacity, without malfunction exemptions, and to continuously monitor opacity. Carmeuse exceeded the 15 percent average opacity limit at its lime kiln stack for 7,938 minutes between April 3, 2020 and September 23, 2024. Carmeuse also failed to demonstrate compliance with the opacity limit by failing to collect continuous opacity monitoring system (COMS) data at its lime kiln stack for 14,592 minutes during May 1?15, 2020 and August 29?30, 2023. A concurrent CAFO will resolve these violations through the payment of a civil penalty. This ACO requires Carmeuse to take the following actions to addresses the violations set forth in the FOV issued to Carmeuse on December 31, 2024: (1) Install a replacement COMS for the Lime Kilns #4 and #5 common stack to ensure continuous, reliable compliance monitoring; (2) Perform upgrades on the electrostatic precipitator (ESP) controlling emissions from Kiln #5 to reduce the occurrence of opacity exceedances and to facilitate a timely response by kiln operators when ESP issues do occur; and (3) Revise the written operations, maintenance, and monitoring plan to include procedures for kiln ash management, COMS operation and maintenance, and operator response to control device deviations.
